The SAP is the professional responsible for executing the evaluation, recommending a tailored education or treatment program, and conducting the face-to-face follow-up evaluation to determine if the employee is ready to safely return to work. Will this be confidential?

Your evaluation is clinical and private, but the SAP process is not anonymous. Federal rules require your SAP to report your evaluation status and return-to-duty determination directly to your employer's Designated Employer Representative, and for CDL drivers, to the FMCSA Clearinghouse. Those reports are required by law and don't depend on your consent. Everything else you discuss stays protected under federal and state confidentiality rules. We'll explain exactly what gets shared, with whom, and when — before your evaluation begins.

No. Your SAP determines whether you've met the federal evaluation and treatment requirements and reports that determination. The decision to return you to safety-sensitive duty belongs entirely to your employer.

No. Federal rules limit when a SAP may refer someone to a program the SAP is connected to, and those rules come first. Your SAP's recommendation is based on your clinical needs, and if another provider is the right fit or a more appropriate option is available to you, we'll refer you there. Where our residential program is the clinically appropriate and reasonably accessible option, we'll tell you that in writing and document why.

It depends on your employer's written drug and alcohol policy and any applicable collective bargaining agreement. Some employers cover SAP services; many employees pay directly.
